Terms & Conditions
These General Terms and Conditions are required by German law. The original German version is legally binding. This English translation is provided for your convenience only.
§ 1 Scope
These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between machuPICyou GmbH, Marienplatz 1, 08056 Zwickau (hereinafter "we", "us" or "Seller") and the customer (hereinafter "you" or "Buyer") via our online shop at machupicyou.com.
A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly can be attributed neither to their commercial nor their independent professional activity (§ 13 BGB).
The version of these GTC valid at the time of the order shall apply. Deviating terms of the Buyer will not be recognised unless we expressly agree to them in writing.

§ 3 Offer and Contract Formation
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order (invitatio ad offerendum). Errors and misprints are reserved.
By clicking the "Buy now", "Place binding order" button or an equivalent button, you submit a binding order for the goods in the shopping cart.
Confirmation of receipt of your order is sent immediately after the order by email (order confirmation). This confirmation does not yet constitute acceptance of the offer. The purchase contract is concluded only when we accept your order by a separate order confirmation email or dispatch the goods.
The contract text is stored by us and is accessible to you in your customer account after conclusion of the contract.
§ 4 Products and Prices
We offer illustrated travel and Baltic Sea posters as well as related products. Current products, descriptions and dimensions can be found on the respective product pages in the shop.
All prices on our website are final prices including the applicable statutory value-added tax. Any deviations are explicitly stated.
Shipping costs: In addition to product prices, shipping costs apply. The specific shipping costs will be shown to you before completing the order in the shopping cart and during the ordering process. We offer free shipping within Germany for orders of EUR 50.00 or more.
Price changes are reserved until the time of the binding order. In the event of a price increase after the order has been placed but before dispatch, we will inform you and give you the option to cancel the order.
§ 5 Payment Terms
The following payment methods are available:
- Credit card (Visa, Mastercard, American Express) via Shopify Payments
- PayPal
- Klarna (instalments, instant transfer, invoice – subject to availability)
- Apple Pay
- Google Pay
Payment is due immediately upon completion of the order, unless otherwise agreed for the chosen payment method (e.g. Klarna invoice). Payment data is transmitted in encrypted form directly to the respective payment service provider. We do not store any complete payment data ourselves.
In the event of late payment, we are entitled to charge default interest at the statutory rate (§ 288 BGB) as well as reminder costs.
§ 6 Delivery and Shipping
We currently deliver within Germany. Deliveries to other countries are possible on request; different shipping costs and delivery times may apply.
Shipping is exclusively via DHL in a sturdy, protective shipping mailer that prevents folding or damage to the posters. The estimated delivery time after receipt of payment is 3 to 4 business days within Germany. Business days are Monday to Friday, excluding public holidays.
The delivery period begins on the day after receipt of the payment confirmation. If we are unable to meet the stated delivery period for reasons attributable to us, we will inform you without delay and offer a new delivery date. In this case, you have the right to withdraw from the contract.
The risk of accidental loss and accidental deterioration of the goods passes to consumers upon delivery of the goods to you or to a person designated by you.
§ 7 Retention of Title
The goods remain our property until full payment of the purchase price including all ancillary costs.
§ 8 Right of Cancellation
As a consumer, you have a statutory right of cancellation. In addition, we voluntarily grant you an extended return period of 30 days from receipt of goods (see § 9). The full cancellation policy and model cancellation form can be found on our Cancellation Policy page.
§ 9 Voluntary Return Policy (30 Days)
In addition to the statutory 14-day right of cancellation, we grant you a voluntary return period of a total of 30 days from the day you receive the goods. The voluntary return right applies under the following conditions:
- The goods are undamaged, unused and in their original condition.
- You return the goods completely, carefully packaged and at your own cost to our address.
- You notify us of the return in advance by email to support@machupicyou.com.

Return shipping costs are borne by you as the buyer. After receipt and inspection of the returned goods, we will refund the purchase price using the original payment method. This voluntary return right does not affect your statutory right of cancellation or your statutory warranty rights.
§ 10 Warranty and Defects
The statutory warranty rights pursuant to §§ 434 ff. BGB apply. In the event of defective goods, you are initially entitled to supplementary performance (repair or replacement at our choice). If supplementary performance fails twice or is refused by us, you may, at your choice, reduce the purchase price or withdraw from the contract.
The limitation period for defect claims is two years from delivery of the goods.
Please report any transport damage immediately upon receipt of the goods to support@machupicyou.com and document the damage with photos. This facilitates the claims process but is not a prerequisite for asserting your warranty rights.
§ 11 Limitation of Liability
We are liable without limitation for intent and gross negligence as well as for damage arising from injury to life, body or health, for fraudulent concealment of a defect, for the assumption of a guarantee and under the Product Liability Act.
For slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations) whose fulfilment is a prerequisite for the proper performance of the contract and on whose compliance you may regularly rely. In this case, our liability is limited to the foreseeable, contract-typical damage.
Any further liability is excluded.
§ 12 Data Protection

§ 13 Copyright on Products
All images, illustrations and designs offered on our website are protected by copyright. The purchase of a poster entitles the buyer exclusively to private use. Commercial use, reproduction, distribution or making publicly available of the motifs requires our express written consent.
§ 14 Online Dispute Resolution and Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
§ 15 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as mandatory provisions of the law of the state in which the consumer has their habitual residence are not withdrawn.
The place of jurisdiction for merchants, legal entities under public law or special funds under public law is Zwickau. For consumers, the general statutory place of jurisdiction applies.
§ 16 Severability Clause
Should individual provisions of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by an effective provision that comes closest to the economic purpose of the invalid provision.
